One Third Terms & Conditions

Basic information

  • These terms and conditions govern the operation and provision of the Alza One Third service (so‑called "One Third" purchase).
  • By making a "One Third" purchase, you as the buyer enter into an agreement with Alza. These terms and conditions form an integral part of that agreement. No deviations from these terms are permitted.
  • The One Third purchase option (the One Third service) allows you to buy goods/services/licences ("Product") at www.alza.cz / or in the Alza mobile app with payment deferred over 3 months. If you buy a Product via One Third (under the One Third service), you pay 1/3 of the purchase price no later than upon collection, and the remaining 2/3 of the purchase price (so that the full Product price is paid) within 3 months of collecting the Product.
  • You become the owner of the Product the moment you collect it, provided that you have paid 1/3 of the purchase price beforehand. At the same time, however, you enter into a so-called agreement on the security transfer of ownership rights with Alza, which becomes effective if you default on payment of the remaining part of the Product purchase price.

  • If a matter is not covered by these terms and conditions, the General Terms and Conditions shall apply – these include, for example, claim handling rules including out‑of‑court dispute resolution and details concerning rights arising from defective performance.
  • The One Third service is intended only for customers who are fully legally competent individuals over the age of 18; Alza does not provide the One Third service to legal entities. Self-employed individuals may use the service in accordance with these terms and conditions.
  • Normally, agreements concluded "online" may be withdrawn from within 14 days. You may only withdraw from a One Third purchase agreement if identity verification via BankID is used during the purchase; in all other cases, the agreement is concluded directly at the branch store (by signing the handover protocol), and withdrawal within 14 days of a One Third purchase is therefore not possible.

Conditions for using the service

To use the service, i.e. to make a One Third purchase at www.alza.cz / or in the Alza mobile app, you must:

Have a valid, truthful and complete Alza registration for at least 3 months.

Have concluded at least two purchase agreements with Alza within the 12 months preceding the One Third purchase (these agreements must not have been prematurely terminated by you as the buyer, e.g. by withdrawing from them within the 14-day period.)

Have purchased goods from Alza totalling at least 5,000 CZK within the 12 months preceding the use of the One Third service.

Prove that you are capable of paying the full purchase price for the Product properly and on time. Therefore, when purchasing, you must provide your permanent residential address (which must match the address shown on the ID document presented when collecting the goods) and your personal identification number.

It is possible to make purchases and pay via One Third repeatedly, provided that your total debt to Alza does not exceed the set limit (maximum outstanding amount). The limit amount, or the remaining available limit, will be shown during the purchase process.

To purchase via the One Third service, you must have a fully completed registration, at least 2 previously completed orders, and the value of those orders over the last 12 months must exceed 5,000 CZK incl. VAT. Permanent residence and a personal identification number are also required for creditworthiness verification purposes. 
The One Third service is only available for selected products by using the “Pay only One Third” button displayed on the product detail page.

Initiating a "One Third" purchase

You make a “One Third” purchase by accepting a non-binding offer from Alza displayed on the Product detail page or during the purchase process for the selected Product. During the purchase, you may choose either the “Buy” option (where you pay the full purchase price before collecting the Product in the standard way) or the “Pay only One Third” option, under which we non-bindingly offer you the option to order the Product with deferred payment as part of the One Third service.

By selecting “Pay only One Third”, you are required to pay a deposit equal to 1/3 of the Product purchase price using your payment card, thereby reserving the Product. Please note that payment of the deposit does not conclude the purchase agreement; it only reserves the Product. Alza discount vouchers and gift vouchers cannot be used to pay the 1/3 deposit.

You acknowledge that the One Third service cannot be used together with the Trial Period service or any other service allowing the buyer to return goods within an extended period. The Unwanted Gift Exchange service cannot be applied to goods purchased using the One Third service.

At the time of purchase, you must pay 1/3 of the amount. Collection takes place in person unless BankID verification is used.

Buyer assessment and collection conditions

As part of preventing potential losses, an assessment of you as the buyer will be carried out in two stages: 1) a preliminary assessment of your creditworthiness (i.e. your ability to pay for the purchase), and 2) verification at the branch store.

If the preliminary assessment of your creditworthiness is successful, you will be required to pay a deposit equal to 1/3 of the Product purchase price, thereby reserving the Product.

The Product must be collected at an Alza branch store in person. During branch verification, we also check your identity document. The only exception is a One Third purchase verified via BankID (see section 1.7 of these terms for more information).

If branch store verification is successful, we will sign a handover protocol confirming that you have collected the Product, familiarised yourself with these terms and conditions, and agreed to the security transfer of ownership rights. The moment the handover protocol is signed is also the moment the purchase agreement is concluded (except in the case of BankID verification; see section 1.7 of these terms).

If the assessment is unsuccessful and you have already paid the deposit, we will return the money to your account without delay.

Buyer not assessed successfully

Approval of a purchase via the One Third service is not a legal entitlement. Alza reserves the right not to provide the One Third service to a customer, and also reserves the right not to disclose the reasons for refusing the service.

If the assessment does not go smoothly and you have already paid the 1/3 deposit, we will refund the deposit amount to your account without undue delay, no later than within 24 hours.

Payment of the remaining part of the purchase price

You are required to pay the remaining part of the Product purchase price within 3 months of collecting the Product. The exact due date for the remaining payment is stated on the invoice you receive when collecting the Product (the invoice is also available in your Alza account).

We recommend keeping track of the due date for the remaining balance. Customers sometimes forget to pay the outstanding amount, which can lead to complications for both parties.

Payment of the remaining part in the event of non‑payment

If you fail to pay the remaining part of the purchase price on time (by the due date shown on the invoice), you agree that we may charge the outstanding amount to your saved payment card with the relevant bank. We may also offset the outstanding amount against any claims you may have against Alza.

One Third purchases and BankID verification

During the purchase, you may choose verification via BankID. In such a case, these terms and conditions, including sections 1.1–1.6, shall apply with the following exceptions:

The purchase agreement with BankID verification is concluded at the moment the deposit is paid (i.e. payment of 1/3 of the Product price) and the preliminary creditworthiness assessment is successfully completed. If the creditworthiness assessment is unsuccessful, no agreement is concluded and section 1.4 of these terms applies.

You may withdraw from a One Third purchase contract with BankID verification within 14 days under the General Terms and Conditions.

Collection of a Product verified via BankID does not have to take place at an Alza branch store in person (nor is an ID check required). You can have the Product delivered to one of our stores, to an AlzaBox, or directly to your home.


Security transfer of ownership

Together with the Product purchase agreement, we also conclude, pursuant to Section 2040 of the Civil Code, an agreement on the security transfer of ownership rights (hereinafter the “Security transfer agreement”).

Under this Security transfer agreement, you transfer ownership of the Product you bought via One Third to Alza (the Product is specified on the invoice and in the handover protocol), for the purpose of securing Alza's claim arising from the purchase contract concluded under the One Third service and any further claims under that purchase contract, including agreed fees (contractual penalties) and reasonably incurred costs. Alza accepts ownership of the said Product.

The security transfer of title for a Product bought via One Third is agreed subject to a suspensive condition that you default on payment of the remaining part of the Product's purchase price. This means that ownership of the Product transfers to Alza on the first day of your default on payment of the remaining part of the Product price.

The security transfer is also agreed subject to the resolutory condition that the buyer’s debt to Alza is fulfilled in accordance with these terms. This means that if you fail to pay the remaining amount properly and on time even after an additional grace period is granted, the transfer of ownership rights to Alza becomes unconditional.

Once the transfer of ownership rights to Alza becomes unconditional, you are required to return the Product to Alza without undue delay, no later than within 3 days of Alza’s request. Alza is entitled to sell the Product at the usual market price at the relevant place and time, and use the proceeds to settle its claims against you arising from the purchase agreement.

When returning the Product, you must provide Alza with maximum cooperation once requested by Alza as the owner of the Product.

If, for any reason, you are unable to pay the remaining part of the purchase price, contact us as soon as possible. In most cases, it is possible to arrange a return of the Product provided you pay us usage costs (Product rental fees) for each commenced month of use as follows:

for the first month of use, the cost is 12% of the Product's purchase price,

for the first and second months of use, the cost is 23% of the Product's purchase price,

for the first, second and third months of use, the cost is 33% of the Product's purchase price. Any part of the Product purchase price already paid will, of course, be refunded after deducting the Product usage costs. Any commenced month of use is counted from the date of Product collection. If you return the Product damaged, we may also require you to pay a fixed compensation fee under Article III of these terms.

Until the Product purchase price has been paid in full, you may not assign or transfer any rights or obligations arising from these terms and the One Third service, in particular ownership of the item or your obligation under the Security transfer agreement, to a third party, even free of charge.

If you do not pay for the Product within 3 months, ownership of it transfers back to Alza. You will then be asked to return it.
Until you pay the full price of the Product, you may not sell the Product.


Fees and compensation

If we send you any request to pay the outstanding part of the Product purchase price after the due date, each individual request is subject to a fee of 500 CZK incl. VAT. This fee represents reasonably incurred costs associated with recovering an overdue debt. You must pay the reminder fee within 7 days of receiving the payment request, by bank transfer to the account stated in the request.

If you default on paying the remaining part of the Product's purchase price, we may charge and are entitled to a flat‑rate compensation fee of 0.1% per day of the outstanding amount for each day, even a part of a day, that you are in default, until the outstanding amount is paid in full or the Product is returned. You must pay the flat‑rate compensation fee within 7 days of receiving the payment request, by bank transfer to the account stated in the request.

If the security transfer of title to the Product occurs (or you return the Product to us for any other reason) and the Product is damaged in a way that goes beyond normal wear and tear, we may claim compensation for the damage to the Product. To keep things simple, we will claim a flat‑rate compensation fee as a percentage of the Product's price, to which you as the buyer agree, as follows:

for light damage to the Product (especially scratches, scuffs, gouges, pressure marks) and/or missing accessories, provided the Product can still be used without restriction → a flat‑rate compensation fee of 20% of the Product's price;

for significant damage, e.g. scratches, dents, a broken part, a cracked part, signs of oxidation, damaged connectors, etc. (repair cost is more than 20% but less than 50% of the Product's price), provided the Product can still be used without restriction → a flat‑rate compensation fee of 50% of the Product's price;

for damage that makes the Product unusable, or for complete destruction or loss of the Product → a flat‑rate compensation fee of 100% of the Product's price.

You must pay the flat‑rate compensation fee within 7 days of receiving the payment request, by bank transfer to the account stated in the request.

By making a One Third purchase, you agree that if you do not pay any fee or compensation amount properly and on time (generally within the time stated in the request), we may deduct the amount of the fees and compensations claimed under this Article from your saved card with the relevant bank. We may also set off the amount of the fees and compensations against any claims you may have against Alza.

Payment of a flat‑rate compensation fee does not affect Alza's right to charge statutory interest for late payment or other fees. Please note that late payment may also incur additional costs, e.g. legal fees, court or enforcement proceedings costs.

If you return goods because you cannot pay for them, we will check their condition. If they are damaged, you may be charged a fee.
We may also charge you a fee if you are late paying the remaining price of the goods.


Processing of personal data

The personal data you provide to us under the agreement (whether in the order form or upon collecting the Product) is confidential and processed for the purpose of fulfilling the agreement, on the basis of legitimate interest, and also on the basis of your consent. To verify your creditworthiness, reliability and payment discipline, we may share your personal data with third parties, i.e. companies maintaining databases of liabilities (including information on potential liabilities). Details can be found here and at www.alza.cz/privacy-policy.

If you do not choose in‑person identity verification at a branch or by other means, Alza requires a copy of your ID card, in accordance with the instructions and full wording of the consent to provide a copy of the ID card, available at www.alza.cz/how-to-send-a-copy-of-your-id-document. Please note that we will also ask to see your identity card when collecting the Product, as we need to verify your identity before handing over the Product.

As the buyer, you must notify us of any change to important personal details within 5 days, in particular a change of address, name, payment card, commencement of insolvency proceedings, etc., by updating those details in your Alza user account or via the contact form on the Alza website. It is your responsibility to ensure Alza always has your accurate postal address, current e-mail and telephone number.

When buying via One Third, we process your personal data, mainly for the purpose of concluding and performing the contract. We also carry out a credit check in cooperation with a company that specialises in this.
Please report any changes to your details (e.g. change of telephone number or address) to us.


General provisions

These terms and the relationships arising from them are governed by the laws of the Czech Republic.

If any provision of these terms is or becomes invalid, ineffective or unenforceable, such invalidity, ineffectiveness or unenforceability shall not affect the validity, effectiveness and enforceability of the remaining provisions, unless the law provides otherwise.

Alza reserves the right to amend these terms, and any amendment becomes effective on the date of publication on the Alza website, unless stated otherwise in the terms. An amendment to the terms does not affect the rights and obligations of the parties arising during the validity of the previous wording of the terms.

Alza is entitled at any time to set off any monetary obligations and claims it has against the buyer, even if they arise from different legal relationships.

Alza is entitled to assign any claim arising from the One Third service and/or the Security transfer agreement to a third party.

A buyer who is a business hereby extends the limitation period for all rights (including any rights to damages or contractual penalties) arising to Alza from the One Third service and/or the Security transfer agreement, as well as from previously concluded contractual relationships between the buyer and Alza, to a period of 5 years from the moment the relevant limitation period first starts to run.
